Terms of Service

1. Introduction and Acceptance

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and GO REACH PTE. LTD. (UEN 202423611Z) (“GO REACH,” “we,” “us,” or “our”), governing your access to and use of the GoReach mobile application (the “App”) and all related services, features, and content made available through the App (collectively, the “Platform”).

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy . If you do not agree to these Terms, you must not access or use the Platform.

These Terms were last updated on the Effective Date shown above and are available at https://app.nirvana.sg/tos .

2. About the Platform

GoReach is a digital platform that facilitates memorial-related services, including the browsing and booking of memorial service offerings, the listing of columbarium niches for resale, and the submission of business advertisements within the memorial services sector.

The Platform is provided as a facilitation tool only. GO REACH is not:

  • (a) a provider of memorial services;
  • (b) a broker, agent, or representative of any User; nor
  • (c) a party to any transaction between Users.

GO REACH does not guarantee the availability, quality, legality, or suitability of any service, listing, or advertisement displayed on the Platform. Your use of the Platform does not create any employment, agency, joint venture, or partnership relationship between you and GO REACH.

3. Eligibility and Account Registration

3.1 Eligibility

You represent and warrant that you have the legal capacity to enter into a binding contract under applicable law. If you are a minor under the laws of your jurisdiction, you represent that you have obtained the consent of your parent or legal guardian to use the Platform, and that your parent or legal guardian has read and agrees to these Terms on your behalf. We reserve the right to request verification of such consent at any time.

3.2 Account Registration

To access certain features of the Platform, you must register for an account. During registration, you will be required to provide your email address, first name, last name, and your purpose for using the Platform. You may optionally provide your phone number.

You agree that all information you provide during registration is accurate, current, and complete, and you will update such information promptly if it changes. You are solely responsible for maintaining the confidentiality and security of your account and for all activities that occur under your account.

3.3 Authentication Methods

You may sign in to the Platform using an email magic link, Google Sign-In, or Apple Sign-In. Your use of third-party authentication services is subject to the terms and privacy policies of the relevant provider (Google or Apple, as applicable). GO REACH is not responsible for the practices or policies of these third-party authentication providers.

3.4 One Account Per User

Each User may register and maintain only one account on the Platform. GO REACH reserves the right to merge, suspend, or terminate duplicate accounts without notice.

4. Use of the Platform

4.1 Licence to Use

Subject to your compliance with these Terms, GO REACH grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform on your personal device for your personal, non-commercial use (except where you are using features expressly designed for commercial purposes, such as resale listings and business advertisements).

4.2 Prohibited Conduct

You agree not to:

  • (a) use the Platform for any purpose that is unlawful, fraudulent, or prohibited by these Terms;
  • (b) submit any content or information that is false, misleading, defamatory, obscene, offensive, or that infringes the intellectual property rights or other rights of any third party;
  • (c) impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • (d) interfere with, disrupt, or attempt to gain unauthorised access to the Platform, its servers, networks, or any accounts or data of other users;
  • (e) use any automated means (including bots, scrapers, or crawlers) to access the Platform or collect data from the Platform;
  • (f) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App or any part of the Platform;
  • (g) circumvent, disable, or otherwise interfere with any security or access control features of the Platform;
  • (h) use the Platform to collect, harvest, or store personal data of other users for any purpose not expressly permitted by these Terms;
  • (i) use the Platform to transmit any unsolicited marketing, promotional, or advertising material;
  • (j) use the Platform in any manner that could damage, disable, overburden, or impair the Platform or interfere with any other party’s use of the Platform; or
  • (k) assist or enable any third party to do any of the above.

5. Memorial Service Bookings

5.1 Nature of Bookings

Placing an order through the Platform creates a non-binding service booking request only. It does not guarantee the availability of any service, nor does it constitute a confirmed booking, a contract for services, or any commitment by GO REACH to fulfil the request.

Acceptance of your booking request is at the sole discretion of GO REACH and is subject to separate confirmation by GO REACH outside the Platform.

5.2 Payment

Payment for memorial services is settled directly between you and GO REACH outside the App, via PayNow or such other method as may be agreed at the time of booking confirmation. The Platform does not process, collect, or facilitate any payment for memorial service bookings.

GO REACH accepts no responsibility or liability in connection with any payment made or received outside the Platform in relation to a memorial service booking.

5.3 Cancellations and Refunds

Cancellation and refund terms for memorial service bookings are agreed directly between you and GO REACH at the time of booking confirmation, outside the Platform. GO REACH reserves the right to cancel any unconfirmed booking request at any time without liability.

5.4 Special Instructions

You may provide free-text special instructions with a booking request (up to 300 characters). You acknowledge that these instructions may be included in transactional emails sent to you via a third-party email delivery service and are transmitted to that service as part of the email content. You should not include sensitive personal data in the special instructions field.

6. Resale Listings

6.1 Intermediary Role

The Platform provides a venue for users to list columbarium niches for resale and for other users to view those listings. GO REACH acts solely as an intermediary and is not a party to any transaction between a seller and a prospective buyer. GO REACH does not verify, endorse, or guarantee the accuracy, legality, or quality of any listing, and accepts no liability in connection with any transaction arising from a resale listing.

6.2 Listing Submission and Fee

Submitting a resale listing requires a one-time payment at the price displayed in the App at the time of submission, processed through the Apple App Store or Google Play Store. This fee is non-refundable and is charged per listing submission. Refund requests for this fee are governed exclusively by the refund policies of the Apple App Store or Google Play Store, as applicable.

6.3 Approval

All resale listings are subject to review and approval by GO REACH at its sole discretion. GO REACH may reject, remove, or deactivate any listing for any reason, without notice and without liability.

6.4 Listing Content and Accuracy

You are solely responsible for the accuracy, completeness, and legality of all content you include in a resale listing, including lot details, pricing, photographs, and contact details. GO REACH does not verify or warrant the accuracy of any listing content.

6.5 Visibility of Contact Details

By submitting a resale listing, you acknowledge and agree that:

  • (a) the contact details you provide (including your name, email address, phone number, WhatsApp number, and Telegram handle, as applicable) will be visible to all users of the Platform;
  • (b) your contact details will be indexed by a third-party search service to enable search functionality, and this may involve the transfer of your contact details to servers located outside Singapore (including in the United States); and
  • (c) GO REACH is not responsible for any contact, communication, or transaction that occurs between you and any other user or third party as a result of your listing.

6.6 Immutability and Withdrawal

Resale listings cannot be edited after submission. If you wish to withdraw a listing, you may do so through the Platform. Withdrawn listings will be deactivated but may be retained in a deactivated state in our records for compliance and record-keeping purposes.

8. User-Generated Content

8.1 Your Content

You retain all ownership rights in any content you upload, submit, or make available through the Platform (“Your Content”), including photographs, logos, descriptions, and other materials.

8.2 Licence Grant

By uploading or submitting Your Content to the Platform, you grant GO REACH a non-exclusive, royalty-free, worldwide licence to store, process, display, reproduce, and transmit Your Content solely for the purpose of operating and providing the Platform. This licence continues for as long as Your Content remains on the Platform and terminates when Your Content is removed from the Platform, except that GO REACH may retain copies of Your Content to the extent necessary for backup, archival, compliance, or legal purposes.

8.3 Your Representations

You represent and warrant that:

  • (a) you own or have all necessary rights, licences, and permissions to upload and grant the licence described in Section 8.2 for Your Content;
  • (b) Your Content does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, or any other rights of any third party; and
  • (c) Your Content does not violate any applicable law, regulation, or these Terms.

8.4 No Obligation to Monitor

GO REACH is not obligated to monitor, review, or moderate Your Content before or after it is published on the Platform, but reserves the right to do so. GO REACH may remove, edit, or disable access to any content at any time, for any reason, without notice and without liability.

9. Intellectual Property

9.1 GO REACH Intellectual Property

The Platform, including the App, its design, layout, text, graphics, logos, icons, images, software, source code, and all other materials and content made available by GO REACH (collectively, “GO REACH IP”), is owned by or licensed to GO REACH and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in any GO REACH IP except for the limited licence granted in Section 4.1.

9.2 Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any GO REACH IP except as expressly permitted by these Terms or with our prior written consent.

9.3 Trademarks

“GoReach,” the GoReach logo, and any other trademarks, service marks, and trade names used on the Platform are the property of GO REACH or its licensors. You may not use any such marks without the prior written consent of GO REACH.

10. Push Notifications

The Platform may send you push notifications relating to your bookings, listings, advertisements, and platform announcements. You may disable push notifications at any time through your device’s operating system settings. Disabling notifications may affect your ability to receive timely updates about your account activity.

Push notifications are transactional and informational in nature. We do not send marketing communications through push notifications.

11. Third-Party Services and Platforms

11.1 App Store and Play Store

The App is distributed through the Apple App Store and Google Play Store. Your download and use of the App is also subject to the terms and conditions of the applicable store. In the event of a conflict between these Terms and the applicable store’s terms, these Terms shall govern as between you and GO REACH to the maximum extent permitted.

11.2 Third-Party Websites and Services

The Platform may contain links to or integrate with third-party websites, services, or content. GO REACH does not control, endorse, or assume any responsibility for such third-party services. Your interaction with any third-party service is at your own risk and subject to that third party’s terms and privacy policy.

12. Disclaimers

12.1 Platform Provided “As Is”

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. GO REACH EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

12.2 No Guarantee of Availability

GO REACH does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. GO REACH reserves the right to suspend, modify, or discontinue the Platform or any feature at any time, with or without notice, and without liability to you.

12.3 No Professional Advice

Nothing on the Platform constitutes professional, legal, financial, religious, or funeral services advice. The Platform provides a facilitation and information service only. You are solely responsible for your own decisions and actions in connection with the use of the Platform.

12.4 Listing and Advertisement Disclaimers

GO REACH does not verify, endorse, or guarantee the accuracy, completeness, reliability, or legality of any resale listing, advertisement, or other user-generated content on the Platform. Any reliance you place on such content is at your own risk.

13. Limitation of Liability

13.1 Exclusion of Certain Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GO REACH, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF GO REACH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.2 Aggregate Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF GO REACH ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO GO REACH THROUGH THE PLATFORM IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED SINGAPORE DOLLARS (S$100.00).

13.3 Applicable Law Qualifications

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under the Unfair Contract Terms Act (Cap. 396) of Singapore to the extent it applies to these Terms. The limitations and exclusions in this Section 13 apply to the maximum extent permitted by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless GO REACH and its directors, officers, employees, agents, partners, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • (a) your use of or access to the Platform;
  • (b) your breach of these Terms or any applicable law or regulation;
  • (c) Your Content or any content you submit, post, or make available through the Platform;
  • (d) any transaction or interaction between you and any other user or third party in connection with the Platform; or
  • (e) your infringement or misappropriation of any intellectual property or other rights of any third party.

This indemnification obligation survives the termination of these Terms and your cessation of use of the Platform.

15. Account Suspension and Termination

15.1 Termination by GO REACH

GO REACH reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate your account and your access to the Platform for any reason, including but not limited to breach of these Terms, suspected fraudulent or unlawful activity, or at the request of law enforcement or other government authorities. GO REACH shall not be liable to you or any third party for any such suspension or termination.

15.2 Termination by You

You may close your account at any time by contacting us at support@nirvana.sg . Closing your account does not relieve you of any obligations accrued prior to termination, including any outstanding fees or liabilities.

15.3 Effect of Termination

Upon termination of your account, your right to access and use the Platform ceases immediately. Any active listings or advertisements associated with your account may be deactivated. GO REACH may retain your personal data in accordance with our Privacy Policy and applicable law.

Sections of these Terms that by their nature should survive termination shall continue in full force and effect, including but not limited to Sections 8 (User-Generated Content), 9 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 17 (Governing Law and Dispute Resolution), and this Section 15.3.

16. Amendments

GO REACH reserves the right to amend these Terms at any time. When we make changes, we will update the Effective Date at the top of these Terms and notify you through the App or by other reasonable means.

Where amendments are material, we will request your consent to the updated Terms before your continued use of the Platform. If you do not consent to the amended Terms, you may discontinue your use of the Platform and close your account as described in Section 15.2.

Your continued use of the Platform after the Effective Date of any amendment constitutes your acceptance of the amended Terms.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of laws principles.

17.2 Jurisdiction

You agree that the courts of the Republic of Singapore shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. You irrevocably waive any objection to the venue or jurisdiction of such courts.

18. General Provisions

18.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GO REACH with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, understandings, representations, or communications, whether written or oral, relating to the Platform.

18.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, while preserving its original intent as closely as possible.

18.3 Waiver

The failure of GO REACH to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of GO REACH.

18.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of GO REACH. GO REACH may assign, transfer, or delegate its rights and obligations under these Terms without restriction.

18.5 No Third-Party Beneficiaries

These Terms do not confer any rights or benefits on any third party unless expressly stated otherwise.

18.6 Language

These Terms are drafted in the English language. In the event of any inconsistency between the English version and any translation, the English version shall prevail.
